Terms of Service

These terms govern your use of Mentionify at mentionify.ai (“the service”), operated by Alpaca Agency, Inc., a Delaware corporation (“we”, “us”). By creating an account or using the free checker you agree to them. Our Cancellation & Refund Policy and our Privacy Policy form part of these terms.

1. What the service is

Mentionify monitors how AI assistants answer questions you configure, and reports how your brand and others appear in those answers. The reports describe what third-party AI models said at the time we asked; we do not control those models and do not guarantee what they will say, or that their answers are accurate.

2. Accounts

You need an account for everything beyond the public site and the free checker. Keep your credentials confidential; activity under your account is your responsibility. You must provide a working email address — it is how we reach you about billing and service changes.

3. Plans, credits, and billing

• Prepaid months. Paid packages are billed monthly in advance. Prices are set and charged in US dollars. Payment is processed by Stripe, on Stripe’s own hosted checkout page — we never receive or store your card number. If your card is issued in another currency, your own bank does the conversion at its rate. Your package runs to the same day of the following month.
• Credits are what a check costs. Each package includes a monthly bucket of credits, and every check spends credits according to the model it asks (Gemini 1, ChatGPT 2, Claude 3). Your balance is the only limit on how many topics you track, how often, and on which models. Included credits refresh at the start of each period and do not roll over.
• Top-up packs. You can buy extra credits at any time. They are a one-off purchase, are spent only after your included credits, and stay usable for 12 months from the date you buy them.
• Auto-refill is optional and off unless you switch it on. If you turn it on, you authorise us to charge your saved card for the top-up pack you chose whenever your balance falls below the threshold you set — never above the monthly ceiling you set, and never for a different amount. You can turn it off at any moment on the billing page.
• Auto-renewal. If you save a card, we charge it at the end of each period to renew the same package. You can turn auto-renewal off at any time on the billing page; your package then simply expires at the period’s end. Auto-renewal and auto-refill are separate authorisations and are switched off separately.
• Plan changes. Upgrades take effect immediately and the unused value of the old package converts into extra days of the new one. Downgrades are paid at checkout and take effect when the current period ends.
• Failed checks are returned. If a check fails on the AI provider’s side, its credits go back to your balance automatically when the run settles.
• Expiry. When a package lapses, scheduled runs pause and your data is retained; any top-up credits you hold can still be spent by hand, and renewing resumes where you left off.

4. Acceptable use

You agree not to:

• resell or white-label the service without a written agreement;
• use automation to circumvent rate limits or fair-use caps (including the free checker’s daily limits);
• use the service to violate law, or to probe or disrupt our infrastructure;
• misrepresent Mentionify data as coming from the AI providers themselves.

5. Your data

You own what you configure and the reports generated for you. We process personal data as described in the Privacy Policy. Questions you track are sent to the AI providers being measured — that is the product working as described.

6. Availability and changes

We aim for continuous availability but the service is provided “as is”, and depends on third-party AI APIs we do not control. We may change features, models measured, or prices; price changes never apply retroactively to a period you have already paid for.

7. Liability

To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for decisions made on the basis of third-party AI output the service reports.

8. Cancellation and termination

You can cancel at any time, yourself, from the billing page — there is no notice period and no cancellation fee. Cancelling stops all future charges immediately and never takes away time you have already paid for: your package keeps working to the end of the period you bought, and then does not renew. Auto-refill is switched off separately, on the same page.

You can also close your account at any time from the account page. Closure is scheduled for the end of the period you have paid for, everything keeps working until then, and you can undo it at any point before it happens. Your data is erased when that date passes; records of payments are kept for as long as accounting and tax law requires.

Refunds. Time you have already paid for is not refunded when you cancel, because you keep it: the service runs to the last day of the period. Beyond that:

• New customers get 14 days. Ask within 14 days of your first payment and we refund it in full, provided no credits have been spent on the account.
• We always refund what should not have been taken — a charge after you cancelled, a duplicate or incorrect amount, an auto-refill outside the threshold or monthly ceiling you set, or a charge you did not authorise.
• Credits already spent are not refunded, and neither is an account we terminate for a breach of these terms.
• Refunds are returned to the card that was charged, through Stripe, which processed it. If we terminate your account for any reason other than a breach, or discontinue the service, we refund the unused part of what you paid for.

We may suspend or terminate accounts that breach these terms; where practical we will warn you first.
